1. Eligibility

You must be at least 18 years old to use this Site. By using the Site, you represent and warrant that you are at least 18 years of age.

2. User Accounts

To post listings or access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content and Moderation

• You may upload text and images as part of your listings. By submitting content, you warrant that you own or have all necessary rights to such content. By submitting content, you grant Abigon LLC a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Site.
• All content is subject to moderation. We review submitted content within 24 hours. We reserve the right to remove or refuse any content at our sole discretion, especially if it violates these Terms or applicable law.
• Upon deletion of your account or content, such information will be permanently removed from our active systems and cannot be restored. Abigon LLC is not responsible for any loss resulting from the deletion of content or accounts.

4. Prohibited Content and Activities

You agree not to post, upload, or transmit any content or engage in any activity that:

• Violates any applicable law or regulation (including, but not limited to, laws regarding weapons, controlled substances, discrimination, or intellectual property).
• Constitutes "adult content," including but not limited to pornography, sexually explicit or suggestive images, nudity, or any material intended to cause sexual arousal.
• Is false, misleading, defamatory, obscene, or otherwise objectionable.
• Involves spam, unsolicited advertising, fake listings, scams, or fraudulent activity.
• Infringes the rights of any third party.

We reserve the right to suspend or terminate your account for violations of these Terms.

5. No Paid Services (for now)

Currently, all services on Abigon are free. If paid features are introduced in the future, additional terms will apply.

6. Intellectual Property

All content and materials on the Site, except for user-generated content, are the property of Abigon LLC or its licensors and are protected by copyright and other intellectual property laws. You may not use, copy, or distribute any content from the Site without our prior written consent.

7. Disclaimer and Limitation of Liability

• The Site and its services are provided "as is" and "as available." We make no warranties, express or implied, regarding the Site's operation or the information, content, or materials available.
• Abigon LLC is not a party to, and does not guarantee, any transaction or communication between users. You are solely responsible for your interactions and transactions with other users.
• To the extent permitted by law, Abigon LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site. Where permitted by law, our liability is limited to $100.

8. Indemnification

You agree to indemnify and hold harmless Abigon LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

9. Governing Law and International Use

• These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in California.
• This Site is intended for use by individuals located in the United States. We do not knowingly market to or solicit users from the European Union or other jurisdictions subject to the General Data Protection Regulation (GDPR). If you are located outside the United States, you use the Site at your own risk and are responsible for compliance with local laws.

10. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Site. Your continued use of the Site after changes become effective constitutes your acceptance of the new Terms.
